Professional Misconduct: New York’s Unified System, 28 Westchester Bar Journal 15 (2002)
Abstract: In New York professionals other than doctors and lawyers are regulated by the state Board of Education under the supervision of the Board of Regents. Professionals are disciplined after a full hearing before a state board composed on 5 individuals, 4 of whom are peers and 1 lay person. Administrative appeals can be taken to the Regents Review Committee and the Board of Regents. The system is called a unified system because it applies to all of the professions that are regulated. Many practitioners are unaware of the system and of the procedures that must be followed. In this article Marrow provides an overview of the process.
